Terms of Service

1. About these terms

These terms govern your use of Calenya, the online booking platform operated by Calenya ("we", "us"). By creating an account you agree to these terms. If you do not agree, do not use the service.

2. The service

Calenya provides booking management software for self-employed professionals and small businesses in the UK, including appointment scheduling, client management, SMS/email notifications, and business analytics. We are a software platform - we are not a party to any booking between a business and their client.

3. Accounts and eligibility

  • You must be 18 or older and based in the United Kingdom to open a business account.
  • You are responsible for keeping your login credentials secure.
  • One account per business. You may not resell access to Calenya.
  • You must provide accurate business information. False information may result in account termination.

4. Subscription and payment

  • Calenya costs £10 per month (inc. VAT where applicable), billed monthly via Stripe.
  • New accounts receive a 14-day free trial. No charge until the trial ends.
  • Subscriptions renew automatically. You can cancel at any time from your account settings.
  • Cancellation takes effect at the end of the current billing period - no pro-rata refunds.
  • We reserve the right to change pricing with 30 days' notice. You may cancel before the new price applies.
  • Failed payments will trigger automated reminders. Access may be suspended after 7 days of non-payment.

5. Acceptable use

You must not use Calenya to:

  • Collect bookings for illegal services or activities prohibited under UK law
  • Send unsolicited marketing messages to clients who have not consented
  • Upload malicious code, attempt to reverse-engineer the platform, or access other users' data
  • Misrepresent your identity or business to clients

Violation of these rules may result in immediate account suspension without refund.

6. SMS and email notifications

By using Calenya, you acknowledge that the platform will send automated SMS messages and emails to your clients on your behalf (booking confirmations, reminders, and review requests). You are responsible for ensuring you have a lawful basis to communicate with your clients under UK PECR and UK GDPR. Calenya acts as a data processor on your instructions for this purpose.

7. Intellectual property

The Calenya platform, branding, and software remain the property of Calenya. Your business data (services, bookings, client records) remains yours. We grant you a non-exclusive licence to use the platform for the duration of your subscription.

8. Availability and uptime

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be announced in advance where possible. We are not liable for losses arising from unplanned downtime, including missed appointments or lost bookings.

9. Limitation of liability

To the maximum extent permitted by UK law, Calenya's total liability to you for any claim arising from use of the service is limited to the fees you paid in the 3 months preceding the claim. We are not liable for indirect, consequential, or lost-profit damages.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

10. Termination

Either party may terminate at any time. If we terminate your account for cause (e.g. acceptable use violations), no refund will be issued. If we terminate without cause, we will refund a pro-rata portion of your current month's subscription.

On termination, you may request an export of your business data within 30 days. After 30 days, data will be permanently deleted subject to our retention obligations.

11. Governing law

These terms are governed by the laws of England and Wales. Disputes will be resolved in the courts of England and Wales.
